INTELLECTUAL PROPERTY SECURITISATION RISK ANALYSIS, LEGAL REGULATION, AND MANAGEMENT STRATEGIES: FROM CHINESE PERSPECTIVE

ABSTRACT: Intellectual property securitisation serves as a valuable tool for both social investment and intellectual property development. By reducing the cost of social investment, it can effectively assist small and medium-sized enterprises overcome their financing challenges. The involvement of social investment has greatly boosted the growth of China’s intellectual property industry, while also enhancing the public’s understanding of intellectual property protection. This article provides an overview of the current state of intellectual property securitisation in China and evaluates the legal risks associated with its operation. China’s intellectual property securitisation market has the opportunity to draw valuable insights from international experience and enhance its own laws, policies, and regulations to align with its unique development requirements. Additionally, it can contribute to the achievement of the objectives of enhancing securities market oversight and establishing consistent practices for intellectual property securitisation, and to facilitate the industry’s efficient growth.
